Liability Agreement

Read the full liability agreement below. You are agreeing to this liability waiver on behalf of all participants in your group.

YMCA'S CAMP CHEERIO PARTICIPANT AGREEMENT
(Including Assumption of Risks, Release of Liability and Indemnity)

Please read this Agreement carefully. This is a contract and your signature below indicates that you have read and understand every provision of this Agreement and that you unequivocally agree to all terms, conditions, and promises herein.

As consideration for allowing the Participant to attend and participate in the program and services offered by The Young Men's Christian Association of High Point, Inc., a North Carolina non-profit corporation (hereinafter referred to as "CAMP CHEERIO") I, the undersigned parent (or guardian) of the Participant, on my own behalf and on behalf of the Participant, agree and promise as follows (Participant and Parent individually and collectively referred to as "we", "us", or "our"):

INFORMED CONSENT TO AND ASSUMPTION OF RISK OF INJURY: We acknowledge that we are fully aware of all aspects of CAMP CHEERIO's programs, activities, and risks. We have been given ample opportunity to ask any questions which we may have about activities and the environments to which the Participant may be exposed. We find and accept that the activities and programs of CAMP CHEERIO are reasonably safe and suited for the purposes of the Participant's participation in the program.

We also understand, accept, and assume the dangers and risks which are inherent in the operation of a wilderness program and in the Participant's participation in CAMP CHEERIO's activities. We know and understand that outdoor activities cannot be 100 percent safe. We understand that even with appropriate preparation, outdoor activities involve risks, including those that are inherent to the nature of the program. We understand that due to the nature of the activity, there remain risks that can result in loss or damage to property and/or loss or damage to the Participant, including injury, illness, disability, emotional and/or psychological trauma, and death.

THE FOLLOWING DESCRIBES SOME, BUT NOT ALL, OF THESE INHERENT RISKS:

  1. ENVIRONMENTAL HAZARDS: We understand, accept, and assume the risks arising from the fact that CAMP CHEERIO participants live, camp, travel, and recreate out of doors, where the Participant is subject to numerous risks, including, but not limited to, environmental hazards and risks, including weather conditions, which can change to extreme conditions without notice, lightening, earthquakes, tsunamis, volcanoes, forest fires, landslides, flooding, steep slopes, water conditions (temperatures, waves, rapids, etc.), insects, snakes, bears or other animal encounters, falling and rolling rock, ice and timber, and hidden or unavoidable obstacles. Risks also include, but are not limited to, sunburn, hypothermia, frostbite, dehydration, heatstroke, altitude sickness, poison oak/ivy, ticks, and mosquito bites.
  2. OUTDOOR RECREATION AND ACTIVITIES : We understand, accept, and assume the risks arising from the fact that CAMP CHEERIO activities may include, but are not limited to, hiking, backpacking, horseback riding, rock climbing, kayaking, paddle-boarding, canoeing, swimming, and use of climbing walls and high ropes courses. We also play various games in a wide range of environments, including field sports, challenge games and target (archery, rifle, BB guns, and shotguns) sports. Participants may prepare meals over gas stoves and may do other camp-related work that is varied and sometimes unfamiliar. Water often requires disinfection before use, and camping exposes participants to a variety of hazards, including, but not limited to, burns, sunburns, cuts, insect bites, diarrhea, and flu-like illness. We further understand, accept, and assume the risks that many of these activities will be provided by third party operators who control and oversee their activities and over whom CAMP CHEERIO has no control.
  3. MEDICAL CARE: We understand, accept, and assume the risks that CAMP CHEERIO programs occur in remote places, sometimes several days away from medical facilities. Communication and transportation can be difficult, and sometimes evacuation and medical care may be significantly delayed. We understand that many areas where the Participant may travel do not have cell phone service.
  4. TRAVEL: We consent to Participant participating in scheduling trips that occur off CAMP CHEERIO'S property. We understand, accept, and assume the risks that travel may be by van, car, raft, canoe, kayak, other watercraft, bike, on foot, and by any other means, over rugged and often unpredictable terrain, including, but not limited to, boulder fields, downed timber, rivers, rapids, river crossings, mountain passes, snow, glaciers, slippery slopes and rocks, ocean tides, and currents. Attendant risks include environmental risks, collision, falling, capsizing, drowning, and others typically associated with such travel. Transportation to and from sites will typically involve large passenger vans. We understand that these vans will travel on dirt and Forest Service roads as well as paved highways, and that in the event of a collision, a van provides less side impact protection than a school bus would and is more likely to overturn. We are aware of the risks of traveling in large passenger vans and accept this risk as a necessary component of the CAMP CHEERIO experience.
  5. HUMAN RISKS: We understand, accept, and assume the risks that could arise from the acts, conduct, and mental/emotional state of the Participant and his/her fellow participants that are outside the control of CAMP CHEERIO. These risks may include, but not be limited to, episodes of panic or similar emotional episodes, negligent acts by the Participant or other participants, and failure to follow direction or instruction.

RESPONSIBILITY FOR OWN SAFETY: Participant agrees to adhere to all rules and regulations of CAMP CHEERIO. Decisions are made by CAMP CHEERIO instructors in a wide range of wilderness and other settings based on a variety of evaluations and perceived information which by nature may be imprecise and subject to error. Participants interact with fellow participants, CAMP CHEERIO staff, the staff of third-party operators, and members of the general public. Throughout the program, we understand that CAMP CHEERIO expects Participants to actively accept and take responsibility for their own safety. CAMP CHEERIO does not provide accidental injury insurance.

FITNESS TO PARTICIPATE: We have accepted responsibility to verify with the Participant's physician that the Participant has no past or current physical, emotional, or psychological conditions or issues that would prohibit or interfere with the Participant from fully participating in the program. We have also accepted the responsibility to verify that the Participant understands the physical preparedness as outlined in the information provided by CAMP CHEERIO. We certify that, to the best of our knowledge, Participant is able to safely participate in the Activities for which Participant is registered. The Participant agrees to comply with the instructions and directions of the CAMP CHEERIO instructors during the course of this program, whether verbal or in writing. We understand that CAMP CHEERIO reserves the right to refuse to allow any person to participate who is judged to be incapable of meeting the rigors and requirements of participating in the program. Therefore, we represent that the Participant is fully capable of participation in the program, without causing harm to the Participant or others. WE ASSUME AND ACCEPT FULL RESPONSIBILITY FOR 1) THE PARTICIPANT'S ABILITY TO PARTICIPATE AND 2) FOR PERSONAL INJURY, EMOTIONAL OR PSYCHOLOGICAL TRAUMA, DEATH, LOSS, OR DAMAGE TO PERSONAL PROPERTY, AND EXPENSES SUFFERED AS A RESULT OF THE PARTICIPANT'S NEGLIGENCE OR INAPPROPRIATE DECISIONS OR ACTIONS WHEN PARTICIPATING IN THESE ACTIVITIES.

AUTHORIZATION FOR MEDICAL TREATMENT: Participant, on behalf of myself and my child, hereby authorize and give permission to CAMP CHEERIO to seek, obtain, and consent to provide routine health care, the administration of prescribed medications, and emergency medical treatment for the Participant, as may be necessary, including, but not limited to, radiographic and similar imaging, routine tests, emergency transportation and treatment, surgery, anesthesia, and/or hospitalization. I further hereby give permission to and authorize any medical care provider attending to the Participant to secure and administer treatment, including hospitalization, surgery and anesthesia for the Participant as may be medically required. I agree to the release of any and all records necessary for treatment, referral, billing, or insurance purposes relating to the Participant.

COST OF MEDICAL TREATMENT: We agree to pay and accept full and sole financial responsibility for any and all medical services, emergency/medical transportation costs, medical treatments, hospitalizations, surgeries, and/or other types of services provided by any health care provider that may be incurred as a result of Participant's enrollment and/or participation with CAMP CHEERIO. In the event that CAMP CHEERIO pays any expenses for any above described medical treatment or services, we agree to fully reimburse CAMP CHEERIO for those expenses.

GENERAL RELEASE OF ALL CLAIMS AND COVENANT NOT TO SUE: WE, ON BEHALF OF OURSELVES, OUR HEIRS, AND/OR SUCCESSORS, DO HEREBY RELEASE, DISCHARGE, WAIVE, AND PROMISE NOT TO SUE THE YOUNG MEN'S CHRISTIAN ASSOCIATION OF HIGH POINT, INC., dba CAMP CHEERIO, ITS OWNERS, MANAGERS, MEMBERS, SHAREHOLDERS, OFFICERS, DIRECTORS, ADMINISTRATORS, AGENTS, EMPLOYEES, VOLUNTEERS, AND/OR OTHER PARTICIPANTS, OFFICIALS, RESCUE PERSONNEL, SPONSORS, ADVERTISERS, AND/OR ANY OTHER PERSONS OR ENTITIES ASSOCIATED WITH THE PROGRAM (HEREINAFTER “RELEASEES”) FOR AND FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, LOSSES AND/OR DAMAGES FOR PROPERTY DAMAGE, PERSONAL INJURY, EMOTIONAL TRAUMA, AND/OR DEATH ARISING FROM AND/OR RELATED TO OUR (PARTICIPANT AND PARENT) PARTICIPATION OR INVOLVEMENT IN THE PROGRAM.

I understand and agree that by participating and/or by allowing my child to participate at CAMP CHEERIO, I am accepting and assuming the risk that I or my child may be exposed and become ill as a result of COVID-19 and other communicable diseases and that it is an inherent risk of attending CAMP CHEERIO programs this year.
In addition to the release of claims I agreed to in the Participant Agreement for my child to attend CAMP CHEERIO, I, on behalf of myself and our child and our respective heirs, successors, and assigns hereby voluntarily release, forever discharge and covenant not to sue CAMP CHEERIO, Inc. and, if any, its owners, managers, members, employees, agents, and volunteers ("Released Parties") for any claims that may arise out of or relate in any way to my child's exposure to any communicable disease, including but not limited to COVID-19 The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties.

THIS INDEMNITY OBLIGATION CONTINUES BEYOND THE TERM OF THIS AGREEMENT AND THE PARTICIPANT'S PARTICIPATION AT CAMP CHEERIO

The foregoing general release, covenant not to and indemnification paragraphs are applicable to all claims as described above, except for any such claims that arise while the Participant is on property owned or managed by the National Park Service, the Bureau of Land Management, and/or the National Forest Service.

RIGHT TO REFUSE AND EXPEL
We understand and agree that CAMP CHEERIO reserves and retains the right, at its sole discretion, to cancel, reject, and/or refuse the application, admission and/or participation of the Participant in any of its programs and activities and that CAMP CHEERIO can exercise this right at any time, including expelling the Participant while attending and/or participating in CAMP CHEERIO's programs. We further understand and agree that in the event CAMP CHEERIO exercises this right, it may, at its sole discretion, retain or refund any and all deposits, fees, tuition, or other moneys paid for the Participant to attend CAMP CHEERIO.

PHOTOGRAPHIC AND VIDEO RELEASE: For the Participant and myself, I hereby authorize CAMP CHEERIO and its staff to take photographs or videos that may include the Participant or me and to use the same for websites, brochures, newsletters, or in any other CAMP CHEERIO publications.

MEDIATION: We agree that if we have any legal dispute with CAMP CHEERIO, including any claims for personal injury or wrongful death, that cannot be settled through discussions between the parties, we will first attempt to settle the dispute through mediation in Guilford County, North Carolina, before a mutually acceptable and North Carolina certified mediator.

I, the undersigned Parent/Guardian, state affirmatively that I have legal custody over the Participant, a minor child, and have complete authority to sign this Agreement on the Participant's behalf. My consent and agreement to the terms hereof binds me, the Participant, and/or any other guardian or custodian who may also have authority to make such agreements.
